I’m Jake Kimble. I’m one of the owners of Springs Law Group. And I want to talk to you about your health insurance company’s ability to collect out of your settlement.

So when I say health insurance company, I want you to understand I’m also including in this Medicaid, Medicare, the VA, and any of the other government assistance programs—anyone who pays for your treatment related to the auto accident is entitled to be repaid.

So there are several laws that apply here: you have laws on the federal and state levels, which is too much to get into here. But what I want you to understand is that anyone who pays for your treatment related to the accident is entitled to be paid back. They can be paid back either by contract with you so that you can look in your plan documents or by statute.

Your insurance company, whoever you have a plan with, will make a claim. And if you have an attorney, like what we do: we communicate directly with your health insurance company to find out what that amount is and how much they say is owed. We will review it because we don’t always take their word for it. We want to ensure that everything they’re claiming is related to this auto accident before we pay it.

Then sometimes, there will also be a negotiation phase where we try to get them to lower it, which will depend a lot on what state or federal law applies. But yes, they are entitled to be paid back out of the settlement, and the amount will vary depending on who paid what.
